The Roberts Court's First Amendment

Law professor Gregory P. Magarian considers the free speech decisions handed down by the U.S. Supreme Court, led by Chief Justice John Roberts, and concludes that they embody a version of expressive freedom that Magarian calls “managed speech.”

Instead of encouraging diverse speakers, political dissent or the rights of journalists, Magarian argues “managed speech” empowers social and political stability at the cost of robust debate.
